1. Eligibility and Acceptance

You must be at least the age of majority in your province of residence and have the legal capacity to enter into these Terms. By using the Site, you represent and warrant that you meet these requirements.

We may modify these Terms at any time. Material changes will be posted with an updated "Last updated" date at the top of these Terms. Continued use of the Site after modifications constitutes acceptance of the modified Terms.

The trademark "GAM Tech," the GAM Tech logo, and related marks are trademarks of GAM Technical Services Inc. Other trademarks appearing on the Site are the property of their respective owners.

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable licence to access and view the Site for your personal or internal business use only. You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any content on the Site without our prior written consent, except as expressly permitted by these Terms or applicable law.

4. User Submissions

If you submit information, feedback, comments, or other content to the Site ("User Submissions") — such as through contact forms, consultation requests, or newsletter signups — you represent and warrant that you have the right to submit such information and that the information is accurate.

You grant GAM Tech a non-exclusive, worldwide, royalty-free, transferable licence to use, reproduce, and otherwise process User Submissions for the purpose of responding to your request, providing services, and improving our offerings. We handle personal information contained in User Submissions in accordance with our Privacy Policy.

We do not endorse and are not responsible for the content, products, services, or practices of third parties. 7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

GAM TECH AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, INCLUDING LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR REPUTATIONAL HARM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

GAM TECH'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE, WHETHER IN CONTRACT, TORT, STATUTE, OR OTHERWISE, WILL NOT EXCEED THE GREATER OF ONE HUNDRED CANADIAN DOLLARS (CAD $100) OR THE AMOUNT YOU HAVE PAID TO GAM TECH IN CONNECTION WITH THE SITE IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

Some jurisdictions do not permit the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

For clarity, this limitation of liability applies to your use of the Site only. Liability for services provided under a separate service agreement is governed by that agreement.

8. Indemnification

You agree to indemnify, defend, and hold harmless GAM Tech and its directors, officers, employees, agents, affiliates, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Site in violation of these Terms; (b) your violation of any applicable law or regulation; or (c) your infringement of any rights of any third party.

9. Termination

We may suspend or terminate your access to the Site at any time, without notice, for any reason, including violation of these Terms. Upon termination, provisions of these Terms that by their nature should survive termination will survive, including intellectual property provisions, disclaimers, limitations of liability, indemnification, and governing law.

10. Governing Law and Dispute Resolution

These Terms and any dispute arising out of or relating to these Terms or the Site are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of laws principles.

You agree that any claim or dispute arising out of or relating to these Terms or the Site will be resolved exclusively in the courts of the Province of Alberta, located in the City of Calgary, and you consent to the personal jurisdiction of such courts.

11. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will continue in full force and effect.

12. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and GAM Tech regarding your use of the Site and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and GAM Tech regarding the Site.

These Terms do not create an agency, partnership, joint venture, or employment relationship between you and GAM Tech.
